Intra-Company Transfer

Re: Intra-Company Transfer
You absolutely did qualify it. The OP's response seemed like he felt that everything was now hunky dory so I sought to temper that a bit considering how complicated the law is in this regard and how few details we have about the actual duties involved and company structure.
It's usually telling when the company delves into the H and L and when met with challenges in obtaining that status dispatch someone to do the task as a WB or B-1.

Re: Intra-Company Transfer
My circumstances have changed slightly. I will be promoted next month and will have at least four direct reports, so will more likely apply under L-1A.
The process will now begin with the filing of a 'I-129, Petition for a Nonimmigrant Worker'. Does this stage of the process take very long? From my research, it should have been filed sooner, as I will be eligible in the first week of July.
I'd like to help speed things up by compiling as much information as possible prior to being asked for it. What type of information can I expect to be asked for? Should I begin contacting previous employers for references and exact employment dates etc?

Fragoman quoted 6 weeks for me with a blanket petition and premium processing but I was certain they would
Apply for an L-1A visa seeing as I currently manage 36 people across two continents and I will be going into a management position (albeit managing less people), their initial assessment questions seem to indicate am L-1b visa application. I have a call on Monday to work out what's going on.

Another question - I've been thrown a curve ball. I've been offered a lucrative contract in the UK for 6 months, which would really help with our setup costs in the US if a visa were to come through.
Is service broken if I am on a leave of absence from my current employer i.e. will the L1 visa no longer be an option? I'm there a year next month and want them to keep my job open whilst the visa application goes through.

This is what the L1B page says on the USCIS website:
To qualify, the named employee must also:
Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and
Be seeking to enter the United States to provide services in a specialized knowledge capacity to a branch of the same employer or one of its qualifying organizations.

Re: Intra-Company Transfer
Hi Guys,
This is a very similar situation to mine which is why I'm posting in here rather than creating a new post.
Essentially, I have worked for a UK based company for 5 years and we are looking to move into the US market in 1-3 years. I work there as a system administrator where I design, build, and maintain our entire IT infrastructure.
My partner (fiancée) and myself have always liked the idea of permanently moving to the US but due to the tight GC restrictions, we have never applied.
So my question would be, what would be the best visa to initially apply for if/when we plan to set up in the US, an L-1 or a B-1. Is one 'better' than the other?
Secondly, if either the L-1 or the B-1 were approved and I/we moved to the US, how would one apply for a GC and under what category/justification?
This is a mind boggling process which is why I am trying to pin it down as early as possible!
Thanks for your assistance.

Visa choice is in the Employers hands.

As Boiler said, the visa choice is largely up to your employer, and applying for a green card is entirely at your employer's discretion. It is not something you can do alone, and people often find they have very little leverage to persuade their employer to apply for green cards.

Re: Intra-Company Transfer
So the move's still on - HR have met with Fragomen and they will go for L-1A next July, once I've been in my current manager role for one year.
They say the process will start late spring. I'm pre-empting an RFE, as I don't have a degree. Can anybody give examples of what this means in terms of information that must be provided? Is there anything that I can pre-empt and have ready to go?
Also, is there any information available around questions that must be answered during the application process. I want to ensure as much is ready as possible, as the timelines will be very tight with the children starting school next year.
