Interim EAD I-765

Default Interim EAD I-765

Hello :

I have applied for my renewal of I-765 (EAD) after I got my first EAD which got expired. Since its now 90 days past i would like to have the interim EAD I-765. I would like to know few things...

1) Can i work using this interim EAD?
2) How long will that be vaild?
3) Will this effect i.e delay in obtaining my regular EAD?
4) What are the supportive document i have to submit inorder to obtain this interim EAD?
5) If there is any fees involved how much is that?

Please let me know at the earliest.

Yes. That's what the E in EAD stands for!

I'm not sure, but seem to remember 120 days.

No, it shouldn't.

Evidence that you filed the original EAD 90 days earlier. If you filed
with a service center, that should be the the receipt notice.

As far as I know, no fee.

Correction for 2) it is 240 days.

Hey Folks

Thank for the timely reply.

I stay near to SanFranCisco, California. Is that i have to go to Sanfrancisco INS office or any Sanjose INS office which is like 40 miles is also fine, both are in california.

So the supportive document only receipt is good enought. Do i need to take any photo ID? I have a vaild driver licence which i can also use for photo ID or mandatory that i have to carry only my passport for identification?

Why i said like that that going to location which is far away from my place is that my leaved there initially and then moved near to Sanfrancisco. Hence the address on photo ID will be that address.

Just incase if i d't get my original EAD, can i renew this interim - EAD once its time period is about to expiry.

So how soon i can go and apply for the interim EAD can i go on the 91st day it self saying BCIS (f.k.a. INS) i.e. after my 90 days period has being expired since i applied for I-765 i.e. EAD.


Pls let me know the views.

Use the one that has jurisdiction over where you live - usually, the one
that is closest to where you live.

Bring the passport; it is the best document for this kind of purpose.

Didn't you file a change of address with DMV? When you do that, they
should give you a little card that has your new address that you keep
together with your driver's license. At least, that was the way it worked
when I moved a couple years ago. I won't rule out that they changed
policies.

And while you are at it, make sure that you filed the AR-11 with INS, and
bring the return receipt for the notification. It's unlikely that you will
be asked about it, but why take a chance?

Thanks for the responses.

I do have passport but i have sent for visa revalidation. So is it fine if i just go with dmv licence OR i need wait for my passport.

How long does a normal EAD last for, and why, if your application for EAD goes over the 90 day limit do they give you an interim EAD instead? Whats the difference between the two?

One year from issuance.

and why, if your application for

So they don't have thousands of people screaming that they can't work
because they don't have their EAD.

The interim EAD is valid for 240 days, and it looks different from an EAD
issued at an INS Service Center, as it is issued by the INS district office.

Should be fine. Be prepared to explain why you don't have a passport, and
show a return receipt or some other evidence that you actually did send
it. You are not supposed to be without evidence of your status, and
without the passport and I-94, your only evidence is a return receipt, the
cancelled check for the visa fee and/or photocopies of everything you
sent. Normally, it doesn't matter, except that when dealing with BCIS, the
issue may come up.

Hai

Thanks for the response.

So, it would be actually 90 days as on march 17th of 2003 since my application with BCIS for my renewal of I-765.
As i have already got my first time applied I-765 EAD which got expired and then i applied for renewal of I-765 of EAD.
So if i go on say mar20th ? Is that a good time? If what is the best time period for me to go and request for interim EAD?


For my photo ID since PP is not there, i will take my driver license. I will show the receipt of the stuff sent to visa revalidation incase of any questionair with BCIS while going for interim EAD.
Will be there any questions like why i have given for visa revaildation as i am now requesting for interim EAD or so? If so what will be best answer they can expect from me? Just incase I happened to be questioned.

Any time after the 90 days should be OK.

I was able to get the intermid EAD for 9 months from now. Thanks for the advice and tips. This I got from BCIS (a.ka. INS) office in Calfornia. I am expecting job offer from Texas. So I am planning to use this interim EAD and work there which is in the same area of field.

So, taking the worst case condition i.e. I d't get my renewal of EAD by the time interim EAD gets expired. So Can I apply for once again and get another Interim EAD once the time frame of 9 months is passed? If so, assume I am in Texas can I get in Texas OR I have to travel to California to get it renewed.

I would recommend travelling to California. Any time you risk transferring
files from one office to the other, you also risk messing up your case.
