Default I guess it's a trick question.....

I posted this yesterday but no one has responded. I guess it's a question that might
not have an answer. Thanks anyways for having this newsgroup. It gives you a little
peace of mind when you come to one of those questions that you just don't know how
to answer.

I read what means tested public benefits means but the question does not specify just
inside the USA, so I'm not sure what to put there...maybe I'll ask when I go for my
K-1 interview........

Original Post: I-864 Part B asks: "Have you or anyone related to you by birth,
marriage, or adoption living in your household or listed as a dependent on your mot
recent income tax return received any type of means-tested public benefits in the
past 3 years? Yes or No"

I know my US fiancé will be filling this out but I'm getting it prepared ahead of
time for him. How do I answer this? Is any type of public assistance outside of the
USA included in this? I am presently receiving Provincial Gain Disability Benefits
II, which is a fancy way of saying I get welfare for the disabled.

I looked at a few web sites and couldn't find anything, if it's there then I'm
looking in the wrong place. Thanks for the help in advance.

The affidavit is completed by the USC with their financial information. You are the foreign fiancee and the INS doesn't care where your income comes from as long as it is legal. In order words, your being on a public means tested income program is not a problem for him. You cannot include your income on the I-864 A or B because you are not legally married and therefore your income doesn't count.

Hope that solves your dilemma.

Thanks a bunch Andy and Rete...I know I've asked A LOT of questions in the past
month. I really am trying to get the answers on the web but sometimes I just don't
know where to look or I get overwhelmed by all the information.

I've started filling out the paperwork for AOS even though we're not married yet. We
want to get a heads up on it because we know it has to be in before the 90 days are
up. That way if there are any surprises we can deal with them.

I understand that he is the one who "officially" fills out the form. I'm just getting
a head start on it for him. When we submit it we will be married. The question asked
if anyone in your household or that you are married to...since we'd be married by the
time that we put it in, I wasn't sure.

Doesn't matter now because you both answered my question Thank you again!

Didn't mean that you couldn't fill it out ;-) Just that any information pertaining to your financial status is irrelevant. Heck my husband wouldn't know an I-131 from an I-765. I completed all the paperwork and had him sign it on the dotted line. Hmmmm wonder if I should have formally billed them for the services.

PS also remember you can't include the I-864A for yourself unless you have lived in the household for six months.

LMAO Rete Sounds like my fiancé...I filled out the I-134 and sent it to him and
then just had him go get it notarized when he signed and he sent it back...he
wouldn't know where to look for this kind of stuff. Since I'm the one with the most
time on my hands and he works 50-60 hours a week, I'm the one that does all the
research. I don't mind, he's a sweetie, who loves me lots and I love him and
well...I'll spare you the mushy stuff Cheryl
