Default I-94

Hello,

I was in the US from 2001 -2004 on a work permit. While departing
for my home country, I was subjected some extra security check !
Due to this check, I almost missed my flight. The guys at the airline
counter failed to remove the I-94 form. Later I discovered that they
removed my old I-94. Will I be allowed to enter US ? I still have
the new I-94 form which came with my new H1B petition.

If you received the new I-94 form attached to your approved petition while in the U.S., then it almost certainly had the same admission number on it, as the one they took from you. It's the 11 digit number at the top right. They know you left. That should not cause you any problems.

thanks for your reply.
the numbers do match ( on my old I-94 and new I-94). So I guess I'm
safe.
what would happen if one did not return his I-94 form ? Will the person
get deported ?

"Deported" means different things to different people.

Failure to turn in the form could cause someone to be deemed inadmissible and ordered removed upon their next arrival if they fail to prove that they made a timely departure. The officers at the border could believe that the persons visa was voided by an overstay, or that they have a bar from reentry due to an overstay of 180+ days. If the applicant for admission can prove that they made a timely departure some other way then the failure to surrender the departure form can be overcome.

There is discretion, but the burden of proof is on the alien.
