Default I 485 and past history

Hi All:

I need some advice, I was on Student visa , got married in Aug 2001 to US
citizen and filed I 485 in Sep 2001, I was called for Finger prints had work
permit and advance parole.

I was coming back to us (I went to visit my parents for 20 days traveling on
advance parole) I was given hard time at airport they were asking me all
type of questions and the reason was that I was arrested and was convicted
( I filed Guilty plea) for writing an email to coworker. I was fined and was
released no jail term or any thing max sentence term for that crime in
Michigan is less than or equal to year. I had no idea that this will lead me
to this state. Though I was allowed to come back in US and officer said
since this is only a small crime so he cant deport me but still I am
wondering if my application will be approved or not as I have read so many
things though it says Crime's max sentence has to be year or more but still
I am worried and I need some advice.

Hi,
when you filed the paperwork did you indicate that you were arrested,
found guilty, fined and released? And submitted all the evidence of
that?

I wish I could.
In your case the FBI criminal record check will come with your arrest
and show the guilty plea and all that. INS will check that against
your application and will see that you lied on your application form.
That obviously means that you are not of good moral character as
stated in Part 10 section D of N-400 form.
You should expect that your application will be denied. If not, then
they'll send you a letter requesting an explanation. If you reply that
the max punishment was less than a year, you were never in prison and
felt like you didn't have to mention it in your application, they
might believe you. Still you are skating on very thin ice with this.
If the INS misses it (impossible but they did extend the tourist
status of those hijackers), then go to the interview with all the
documentation of your arrest and release. I wouldn't mention it unless
the officer asks for it explicitly.

Don't worry too much. They won't deny and close the case without
asking you for detail. 3 possible scenarios here:

1- they will miss (a real possibility since like most government
offices, these offices are not organized; I am not saying this as 'an
aopprotunity')

2- they found out about it and checked the detail and decide that its
no big deal.

3- they found outabout it and contact you for explanation at which
point, you can explain

If I were, I won't worry too much and corss that bridge when the time
comes. If necessary, hire a lawyer at that time.

I am not a lawyer but I believt he INS is not that dumb to just
dismiss and close the case. If you ask for lawyers' opinion, they will
make you scared more; it is their job.

I wonder if i send my deatls now even if they have not asked, will that help
as I dont want any complicatio0ns and i am very tensed over this. Should I
ask for leagal advice. Its a lot of money that why I never went for it

Hi, Jay.
Most lawyers will give a 30 minute consultation for anywhere between
50 and 100 dollars.
You can go to one and ask about this case and what to do. Ask him
questions like "Have you had this type of case before?", "Were you
able to turn them around in the client's favor?", "How much time did
it take?", "What would you do if I hired you to represent me in this
case?", "How many years of experience do you have practicing
immigration law in Illinois?", "What would you expect the outcome of
this application to be if I let it continue on it's current course?",
"WHAT DOES THE LAW SAY ABOUT THIS?"
