Hello,
My I-140 was approved for CP but then I decided to go for AOS.
I485 filed at 12/01 but my case is not yet processed. According to
NVC, they send back my I-140 to VSC around June 2002 at request
of VSC.
My question: Will this delay my I-485 processing? Will I be placed in
queue same as the people who filed I-485 on 07/02?
Thanks.

I am not privvy to the internal workings of CIS, so take anything I say
with a grain of salt. But it seems to me that, no, this would just be some
internal processing, and you would not be treated like somebody who filed
on 07/02.
Do be aware that any processing times you see from CIS are just
guestimates; even CIS itself does not know the exact numbers. That's why
these numbers aren't formally released, but rather informally communicated
to AILA only.
Also, cases are not necessarily processed in order. It is entirely
possible that they still have some cases from 1999 waiting in the queue
for some reason or another, or conversely that they have some already
processed some cases from 2002. So in that respect, having waited for the
NVC transfer may well have affected your processing time.

Thanks Ingo.
I remembered that my first EAD application took about 10 months to get
approved.
Could it be that VSC is waiting my I-140 to be transfered from NVC to VSC?
However, my depedent's I765 got approved in one month.
I also heard from a attorney that VSC only need an "electronic copy" of
I-140 approval
to processes I485, NOT necessarily a hard copy. Is this true?
In my case, my I-140 was in NVC. But I know someone whose I-140 was
approved for
CP, their I-140 was sent to the consulate of their country even he filed
I-485 immediately
after I-140 approval. Is this normal?
Thanks.

It can be any number of things; I really can't tell.

Yes, possibly. The electronic copy is already stored in CIS' computer
system. The question is simply what procedures CIS uses internally, and I
really do not know anything about that.

Both is quite normal. Remember that CIS won't actually request the I-140
from NVC immediately after you file, but most likely much later, probably
during preliminary processing (which means, around the same time they send
your fingerprint appointment).
