Default how to work for foreign company?

Hey -

I have a question regarding possibility to work for company abroad
part time while maintaining valid H1B status here in the US.

Some people seem to say that the company cannot market any goods to
the US, no US entity can benefit from work etc.

I asked a few lawyers and they say that there is no specific guidance
on marketing goods in the US etc. So where did this even come from?

Although I would do some work for a family based travel agency abroad
they do run a web site so Americans can also make bookings through the
web site. But you cannot book American establishments - just foreign.
But Americans also do book. Internet is available for everybody. So in
other words there is no special script that checks if the IP is from
the US and if it is then the web site does not allow the user to view
it. The web site is also in English because it is standard everywhere
in the world. It is registered in google as well.

Anyways - I would appreciate knowledgable responses on this issue. Can
anybody help here?

Also once you get a green card in the future then can this issue ever
become a problem?

Another thing: once you become a US citizen - can such an issue ever
become a problem?

Anyways - please let me know and if possible please also quote what
sources you got the information from.

If you have already been advised by lawyers... what are you after...something that agrees with your opinion. Take am Immigration Lawyers advice and accept it ...

The fact that BCIS hasn't issued guidance doesn't mean it is legal.
And a good conservative approach that for sure doesn't come back to
haunt you once BCIS issues regulations is to not do it.
Working for a foreign company on a product that is sold in the US can
be seen as essentially "working for gain" in the US, as if the company
was actually located in the US, and as such would be illegal employment.
If the lawyers you asked are any good they would have told you as much.

It probably becomes an issue *before* you'd even get a GC. Unauthorized
employment is a serious issue and can easily result in deportation.

Receiving an immigration benefit through fraudulent means, e.g., hiding
a material fact like unauthorized employment has the risk of having the
benefit revoked. This includes even citizenship.

Hey -

The reason for posting is that I want clarification. I think some
people posted on this newsgroup about requirements working for a
foreign company and none of the lawyers I talked to was able to
confirm the requirements.

So either people in the message board said something wrong or the
lawyers I happened to talk to did not understand this particular
issue.

It would be good for all the people in this newsgroup to understand
this issue.

Please advise.
