How to terminate Green card petition without problem? --Part II
Here is the second question.
My friend, H's wife filed divorce in Dec. 2005 and in the divorce paper she is saying that my friend married to her sole purpose of getting the Green Card. Wife is accusing him as fraud. (Which is not true at all. As I mentioned before they dated for 4 years before they got married - see the timelin at the bottom of this post) She is doing this to erase the history of marriage. (Annulment) I guess she want to be "virgin" again on the Paper. According to the wife, as long as she doesn't report him to INS, my friend will be automatically off from Green Card application without getting penalized and she will get her virginity back. Is it true? Can my friend come back to state as a traveler or as student in future without any problem? Thanks in advance! In case you missed my first post... Here is the timeline. My friend, H got married October, 2004 to Korean-American woman in Hawaii after 4 years of relationship. Filed for Green card in October, 2004. However, wife decided to kick him out from their Hawaii home. He got the Travel Permission from INS and left U.S in June, 2005. He got a job in Korea and staying Korea. (as of February, 2006) |

He didn't even need travel perimission to leave US; it was for re-entering. BTW, you said that the wife said that as long as she didn't report, he wouldn't be penalized? Why would he be penalised just because she reports to INS? Wife seems full of Cr*p; hubby probay kicked her a*s and left US out of fear. > > He got a job in Korea and staying Korea. I can't remember the form number, but the form is printed on cherry red paper ;-). |

Please, I am not trying to make fun of his wife. I just feel really bad
for my friend. I think he still loves her and that's why he is willing to sign the divorce paper even though she is accusing him for Fraud. He just wants her to be happy, I guess. Really, does anyone have good answer for him? Is it really not related between family court and INS? |

Well, if he is inside that the wife gives him hard time and can support her accustaion, then INS (USCIS actually) can deport him but he already left and they can't deport him. She can't just accuse him one-sidedly and win. He should write to USCIS and withdarw his application for the GC. He should inform them that he has alread left US. He should mail everything certified - may be you can mail a set of those for him from US and give him receipt - and save the receipt as proof. |
