How long for I-130 for wife????

Default How long for I-130 for wife????

I sent in my I-130 for my Vietnamese wife about 220 days ago and all I`ve
gotten back so far was the paper notifying me they received it...I know it says
processing this form can take 150-999 days but that`s because it can be used
for many purposes..My friend got his approval notice (Not completely done but
just the INS approval) in 132 days and the 5 other people I`ve asked got their
back around the 150 day mark...Has something gone on lately at INS that could
have slowed things down this much?..My friend sent his paper work in just 2
months before me and his wife is almost ready to go to her interview and I
still haven`t even gotten the first approval notice!!!

Are you a USC?

Yes I am a natural born US citizen...Like I said It`s been 220 days since I
sent my papers in and still haven`t gotten even the first approval notice
back...Everyone else seemed to get their approval notice back in 130-150 days
for a spouse

You can check the case status online at

You need the case number which should be on the upper left hand corner of
your notice.

I guess you should hear anything very soon and at the same time gather
all documents for your wife e.g. marriage certificate, her birth
certificate (2 official copies + the translation of the officical
copies), etc... so you will not lose any time gathering these documents.

Not really..All you get is when it was received and that it takes "150-999
days to process this type of case"..Which isn`t true..The I-130 can take up to
999 days since it can be used for any type of relative BUT when used for a
spouse it should be at the lower end of that range..But the computers at INS
don`t read what type of relative (Spouse,mother,uncle,etc) They see "I-130" and
stop and kick out that same set response

It was sent to the one in Vermont...It has been almost 250 days since I
mailed it in and have received nothing but the letter saying they received
it...I know of 3 people who are through to the interview already and one man
who`s wife is already here in the US..I have found NO ONE else who has taken
more than even 180 days for a I-130 filed for a spouse to at least receive the
approval notice...But they don`t answer e-mail and I can`t get thru on the
phone and the one time I did some idiot told me "It takes from 150-999 days to
process this type of application" (Which is just quoting from the form) Yes it
DOES take up to 999 days but only for an uncle or something...Spouse
applications are always at the bottom end of the range

Check the BCIS Vermont Service Center processing times here:
http://www.shusterman.com/pdf/vsc.pdf. Note that, as of 03/15/2003, the
date of the report, BCIS VSC is processing cases in the I-130 Immediate
Relative Classes category which arrived on or before 08/22/2002. One must
allow about 30 days from the date of beginning processing to the date of
adjudication.

From what you said, your I-130 was filed in July of 2002. This means the
case should be quite close to adjudication right now -- but not way beyond
usual processing time.

When your case does go beyond usual processing time, I recommend that you
ask your Congressperson to make an inquiry. Call the local office of the
Member of the House of Representatives for your district, ask for the staff
member in charge of immigration inquiries, describe your general situation,
and ask for a Privacy Release form. Fill out the Privacy Release form,
attach a one-page letter summarizing your case, and fax it to the staff
member. Then call in a few days to ensure that the inquiry has been placed.

Thank you for the info..I`ll give them just a little longer..Something must
have slowed them down right about the time I sent mine in because as I
mentioned several people who mailed theirs in a month or 2 before mine have
gotten theirs back long ago..Some as fast as 130 days

An immigration lawyer who posts to another group often says that it is
impossible to compare processing times of one petition to another, even
the same petition filed at the same center or office

I would suggest following up on this immediately. I have waited over
400 days so far only to find out that some INS works shredded 90,000
applications to clear out the backlog. Now my wife has been kicked out
of the country and it could be a long time before I see her again.

OMG - you're a victim of the infamous CSC shredding incident ? I was VERY worried about this as my daughter's petition was submitted there on Apr 11th 2002... so far though they either don't appear to have shredded it or are covering it up.

They were supposed to help you reconstruct your case - and also extend the time given to respond to RFE's - for those who replied but whose response was shredded.

I can't help but think there ought to be a class action lawsuit going on for this somewhere........

Has this lawyer ever heard the term "average"?...You divide the number of
petitions by the number of days til process and you come up with what the
average number of days for that type of petition...Especially when you are
talking about tens of thousands of them you get a pretty clear picture of the
"average" process time
