The meeting you need to have is with the Company Immigration Lawyer.

L has nothing to do with can a US Citizen do the role.

“Guess” is the operative word. Given the lack of information, any response will be a question, a “wild assed guess” at that.

The only immigration classification requiring job creation is EB-5 investor. When it comes to E or L classifications, job creation is NOT an express requirement. But it can be important to adjudication of the actual requirements.

As an informed guess, I wonder if OP is aware that an E classification can possibly lead to later EB-1 classification. Been there done that with no head for L-1.

Not totally wild assed, I did think of other reasons, that seemed the most obvious but I certainly would not put money on it, well without good odds.

Interesting you say that, our business model was commercially more aligned with using indirectly employed manufacturers reps as opposed to directly employed reps. The financial strain in having directly employed reps on board for the first few years would have cost us dearly until they gained some serious traction. An L1 would have been much better for our situation when it came to every other requirement for the visa which is a shame as now we're pushing for an O. Our guidance was basically provide some reasonable direct job creation (4 or 5 people by year 3ish) or forget the L1.
Maybe we should have sought an alternative opinion before we parked the L1.

It must be noted that every case is unique and can be fact dependent. Also, quite often, the facts must be examined holistically.

Let's say that the mythical X-1 can be obtained by facts ABCDEFG or perhaps by AGHIJ. You have ABCDFG. Attorney says that E is needed. So, is it possible to get visa without E? Yes it is, but not in YOUR case. So, it can be difficult to answer a question about E in relation to an X visa without being able to look holistically.
