How can my wife daughter get 'legal'?

Default How can my wife daughter get 'legal'?

Hello all. My wife and her daughter are British Citizens. I'm a US citizen. I lived in the UK for 2 years, then we (my soon-to-be wife, her daughter, and I) moved to the US. This was in Devember of 1998. In May of 1999, they went back to UK for 2 weeks, to get an updated temporary Visa, but this only lasted for 6 months. This expired near the end of 1999, so since then they have been 'illegal aliens'. In August of 2001, we got married. Her (our) daughter is now 13. Is there any way that they can become legal without leaving the country? I know when our daughter is 16 she's going to want to drive, etc. Is there anything we can do, even if it takes a couple of years?

as long as you are a usc she you can file 1-130 and 1-485 and supporting documents. for her and her daughter.

If you are a US Citizen there really should be no problems.

Check out this website which is full of postings from people who have
similar questions as yourself, Questions are often answered by an
immigration lawyer for free.

You and your wife will file Forms I-130/I-485 together, and you and your
daughter will file Forms I-130/I-485 together. These will be separate
applications.

They will be filed at the BCIS district office for your residence. BCIS
will eventually schedule an interview for your wife, and an interview for
your daughter. At the interviews, if all goes well, the person will become
a permanent resident of the U.S.

At the same time the I-130/I-485 package is filed, the person can file Form
I-765, applying for employment authorization. Within a period of time (one
day to 3 months depending on which office it is) the employment
authorization will be approved and the person can work legally.
