Help - request for more evidence on I-751
 
I'm totally lost. First question - I presumed that the evidence we
submitted for the I-130 (I was on a visa-waiver) would still be on
file, hence they wouldn't need the same documentation again. Was that
incorrect?

Here's a list of what they have received so far:

-Ticket receipts for trip to Scotland
-Financial contracts on 2 vehicles
-Auto insurance coverage letter for both vehicles with both names
-Credit card statements under both names
-Bank account statements under both names (2 different accounts)
-Cellphone bill showing calls to each other regularly
-Personal property tax receipts
-All joint tax returns we ave filed
-Birth certificate application copy for our child (birth certificate
was unavailable when filing due to the birth being fairly recent)
-Copy of said child's social security card
-Copy of said child's birth story from someone who attended the birth
(she talked about how much my husband and I obviously love each other,
etc)
-Pictures
-Supporting letters from family and friends

What I presumed they already had on file is what we submitted with our
original application. From memory that was basically the above, plus
our marriage certificate, copies of letters and cards from our
relationship, apartment lease, insurance documents showing each other
as beneficiary, etc. But I got a request for more evidence. And I'm
really confused as to why they need more? I had to go and get a stamp
to extend my status at the St. Louis office and the woman said she sees
NO reason why I'd need to send more info, but to do as they say. So
here's what they ask for, followed by my specific questions:

1. Documents to establish that our marriage was not entered into for
convenience. (What else should I send? More cards between us? What else
could show we have a valid marriage that hasn't already been sent?)

2. Lease or mortgage (Admittedly I forgot to put that in... silly me
just presumed that since our prior lease they already had a copy of
was valid through when we submitted the application that would be good
enough!)

3. Financial records showing joint ownership of assets and
responsibility for liabilities, such as joint bank accounts, tax
returns, insurance policies, joint utility bills, or loans (2 bank
accounts, 2 credit cards, 2 vehicle loans, all that proof was sent.
What the heck else do I send? How is that not enough? Most bills are
just in DH's name except the financial ones. I mean the electric bill,
phone bill, etc. are all in DH's name.)

4. A copy of your marriage certificate (How would I have got to this
stage had we not been married? They already have teh certificate!)

5. A copy of the birth certificate of children born to the marriage
(Fair enough, I have that now.)

I'm also having my obstetrician write a letter saying that I am
pregnant with our second child and my husband has been active and
involved in my care, that he's seen our whole family at most visits,
etc. Also my boss is writing a letter to the same effect - that she has
seen my family at work several times.

So now I know I am going to send:
-birth certificate
-letters
-marriage certificate
-lease
-new tax returns from this year and bank statements

What else could they possibly want? I'm most confused about the
financial thing. I just truly don't understand how SIX different joint
accounts can not be enough proof, in various forms, debt for the cars
to the tune of $40k in BOTH our names, etc.

Help... has anyone any ideas? The officer at STL office said we
probably just got 'lucky' and got a new overzealous caseworker. Lucky
us also had that problem at our original interview. *sigh*

Add a general power of attorney for each other ...At our interview they were impressed with that ..and was the only copy of a document they kept...

I'm a little confused on the time period for the evidence you claim you had sent with the I-751 petition. You are best served providing evidence of co-mingled finances and shared obligations for the time period from when you first received the conditional green card until the time of filing the I-751. Evidence on file for the AOS interview does not cover that time period, and the conditional green card is awarded marriages of short term because USCIS wants to have another look at it after two years.

Although you may have provided some of the information they are requested, are you certain that the timeframe (the dates from CGC to I751) is in sync?

Are you sure you didn't have that baby out of convenience? ;-)

Hi
I just received our letter of approval of my I-751. It sounds as if we were in a similar situation: had a baby, was on VW etc etc. We took the list they asked for and made sure we had a few documents under each category.

At the last interview they particularly liked the fact I am the beneficiary of my husbands life insurance.

We didn't even have any joint bank accounts but did have joint credit cards.

I sent in copies of everything to date - not just the new stuff. Perhaps that was the problem. Its so frustrating.

The list of "what they have received so far" is the evidence I sent
dated AFTER my green card approval. A lot of it was repeats from
what they had already receivied, with more current dates (e.g. current
bank statements, but for the same accounts they already had info for).
So yes, I am certain the timeframe is in sync. The tax returns were
ones filed after the application, etc.

And as far as having a baby out of convenience, it certainly didn't
feel very convenient to me! LOL.

One point not mentioned is that is that some, if not all, of the submitted documentation might have been detached from your petition and therefore they need additional evidence.

Resend everything you sent originally and ADD to it as you mentioned further down in your post.

Congratulations on the forthcoming birth of your newest addition to the family.

Thanks Rete. I will resend everything I have sent to date, plus
anything new I can think of. I will label it appropriately, pay a
fortune for postage and cross my fingers.

A friend of mine did her I-751, literally all she submitted was their
mortgage documentation and one bank statement and it was approved! I'm
starting to feel like they want blood..... oh wait, they already took
that!

I hear you. NCPenguin on the BE forum did the same and was approved. There is no reasoning behind it that I have ever seen.

Hi Amber,

You filed with pretty much the same type of stuff that we filed with, except we don't have a child (as you know).

David just got his letter of approval from Nebraska yesterday, so I bet your supporting documentation simply got separated from your application.

Hi Lalita! How are you both? I did email David but hadn't heard back. I
might have an old addy though.

I didn't think about the fact that the documentation might have gotten
separated. Why can't they send a letter saying "We apologise but your
documentation was misplaced, please resubmit it" instead of making me
wonder what to do!

We're both doing pretty good! Congratulations on your 'bun in the oven'! I bet you either got an old email (he uses gmail now) or it got accidentally deleted. If you still have my email address you can try that one.

It would be entirely too logical for them to actually tell you what they need or why! <sigh> I hope it's not too long for you to get everything sorted out with them.
