help please

In June 2001, my step-son went back to the country of his birth. He did
not like it in the U.S. He wanted to go to the University in the
Ukraine. His mother and I agreed to let him go if his grandfather would
move in with him in his mothers home. I had no idea that anyone cared if
he went back. I have recently received a notice that he is in this
country illegally and that he is to appear before a judge in October.
WHAT AM I SUPPOSED TO DO!

First, find a competent immigration attorney. Do not rely on advice you
get here from people on this, or any, newsgroup. Personally, I try my
best, but I'm an amateur volunteer. So are most other people on this
group.
Second, in order to help, an attorney would need more information:
- when did your stepson arrive in the US? - how did he arrive -
specifically, with what type of visa? - did he ever change status to
another category? - did he comply with the terms of the visa? For
instance, if it was a student visa, did he actually go to school full
time? - when did his status end?
- how old was he when he arrived?
- is he married? If so, when did he get married? - what is your (and your
wife's) status in the USA? - exactly what did the notice say? Is it a
deportation hearing, or something quite different?
- what other notices did he receive from INS or CIS in the past? A hearing
is rarely the first you ever hear from them.
So, do yourself a favor and invest into a competent attorney. Feel free to
also post the replies to my questions above here in this group, just don't
post any personally identifiable information here in this global newsgroup
that anybody can read.
