Heard back from Department of state...
FYI ONLY
I was given the following information
#1
I CAN USE THE JOINT RETURN I FILED WITH MY EX HUSBAND EVEN THOUGH I DIDN'T PERSONALLY EARN ANY INCOME. DUE TO THE FACT THAT IS NOT THE CURRENT YEAR.

IF I DIDN'T CLAIM MY CHILD SUPPORT ON MY TAX RETURNS I CAN'T USE IT TO MEET THE REQUIREMENTS.

I CAN HAVE A CO-SPONSOR WITH THE I134 HOWEVER THEY WILL NEED TO USE THE I864 FORM

Glad to hear you recieved a reply so quickly, at all as a matter of fact. So i guess you'll be calming down a tad and just see about that co-sponsor. I was thinking that you should be able to use the joint return I mean that is what "joint" means. so wonderful to hear that you can.

What do you guys think? Does using the I-864 for a co-sponsor make sense? Is that what you are supposed to use?

Generally if the returns are joint returns, they want to see the W-2's
to show your income. Since you don't have any, you might want to write a
statement stating this.

That is interesting since child support would never be on a 1040.

That is also interesting since the I-864 requires 125 percent of poverty
level and the I-134 doesn't. Additionally, the I-864 has more teeth.
