hallo all guys,

i hope i would get help from here.
my spousal visa (k3) is already approved.
(i130 is still pending)
but i want to go down there in usa not on k3 but using the way of H1B visa as one of the best companies is ready to sponsor me.

relationship with my spouse is not working anymore and we are likely to have divorce soon.

would it make any difference on my H1b visa petition ?
i mean would i b able to get h1b visa in such scenario ?

I am so sorry to hear your marriage is falling apart
If a company in the US is willing to sponsor you, I don't see any major problems, you might get ask about the K3.. but as long as you tell the truth you should be ok

thank you for your response to my question.
i was worrying because h1b is non-immigrant visa in nature.
and still my divorce is not done with my husband.
will it make any difference at the time of visa interview ?
because still it takes 5/6 months more to clear out the divorce case.

You are applying for a H1B visa.. not a Fiancee (K1) visa.. so the fact that your divorce is not final won't affect the eligibility to get the work visa
By the way.. the K3 visa.. is a non-immigrant visa also
