H1B - visa revalidation - URGENT
 
Hi

My previous emloyer visa i had in my passport which also got expired on oct 2002 and i wanted to get my visa revalidation.
I have send the documents for H1b visa revalidation i have got few questions..

1) My previous h1b stamping in my passport was oct 2002 of my previous employer and i have sent the document now is that fine i mean i have not crossed the limit of 1 year span which is suppose to be oct 2003.

2) There is a talk of office being shutdown and laying off the whole people, will that effect my visa revalidation assuming that my HR w't notify the ins via our attorney about h1b cancelling for atleast 2 months.

That is correct.

Probably not, if the visa revalidation occurs in a timely way.

No problem. October 2003 should be fine.

No problem. Of course, your passport being sent off would prevent you from
leaving the US when this happens as you would be required. Remember to
file for a change of status to tourist (or have a new employer file a new
H-1B) immediately the day this happens. The visa will still get
revalidated, but of course will be pointless without a valid petition (and
your old petition will be automatically invalid, even without notifying
INS).

I have sent for visa revalidation on jan31st of 2003. I have not received so far the response what should i do? How do i know its status? Please help me.

If you have sent by FedEx and return FedEx envelope prepaid then expect you passport back in 70 to 80 days from the date they received your papers for visa revalidation

Of course if you get laid off and have no new employer, the fact that
you have the visa will not make your stay in the US after that legal.
As people said, you will need to immediately file for change of status
or leave the country (i believe you get 15-30 days). If the change of
status is not approved then you will have to leave as well.

Staying will make you out of status and make any future visa very
difficult if not impossible.

Actually, you have no time in law to leave ... in practice you have
about 10 days or so to leave. If you file for a change of status, you
must do it instantly the day you are laid off otherwise you'll have to
go to your home country to get a passport visa.

I did get my passport with visa revalidated couple of days back.
It took almost 11 weeks.

But thanks to you all guys for the terrific help.
