Default H1b status issue

Hi,
I have few confusions regarding my status issues in US.
I came to US in Sep/2006 on H1b.
Can I go to school part time from mid of Jan/2007, while I am on H1b.
I got admission at one of the schools.
For this do i have to get consent from my employer?
As my H1B is going to expire by this month, my employer insists to
change my status to F1 if at all i have to go to school.
can you please help me out in this situation.

Thank You

I had a H1b for 2 years and worked fulltime and did a part-time Masters
in the evening ... as long as the schooling doesn't affect your primary
reason for being there you are allowed to attend school :) But your
schooling must be part time.

If you are in the US in H-1B status, you may attend school, but only part time and only incidental to your H-1B status.

If you leave your H-1B employment, you will need to obtain F-1 status to attend school and you will need to attend full-time.

If your H-1B is expiring and it sounds like you will not file for an H-1B extension, will you pursue F-1 status? Have you spoken to the school's foreign student office?

Regards,
