I am on a H1B visa and have just been given notice of being laid off. I am
considering going back home to the UK. I have read on several sites that if the
company that relocated you terminates employment before the expiration of the visa
then they are liable for the costs of relocating you back to your country of origin.
The following is a statement that I have found on one site www.workpermit.com:

"Once a company has brought an employee to the US on an H1B visa, should the
company dismiss that employee before the expiry of the visa, the company is liable
for any reasonable costs that the employee incurs in moving him/herself, his/her
effects, and (where appropriate) his/her dependants, back to his/her last foreign
residence. This provision covers only dismissal, it is not relevant when an
employee chooses to resign."

Please can someone confirm whether this is true and applies to lay offs. If so, can
you point me at the legal evidence that supports this.

Thanks, Chris
