Default H1B - no degree

I have been offered a managerial role with a US company very skilled specialised electronics and they have been told to go for a H1B as they can't find anyone with my skills in the US and have been advertising for years.

I am in my 12th year for the same small company, 3 of us. I was just wondering what sort of experience letters they need? Difficult to ask without my boss knowing I'm leaving I guess. I am currently in a mangerial position as such. My previous job was a junior position for 4 years whilst I did a ONC and HNC one day a week.

Did you read the sticky? It basically says that for a H1-B with no degree you need to have:

superior specialist skills with at least 12 years experience
Do you think you have that? If I were you I'd be checking with the immigration lawyer of the company that wants to hire you to see what their interpretation of your specific work experience is.

As tonrob says your first stop in the company's immigration attorney so they understand your background. If they say ok then you need to prepare a detailed account of your experience over the past 12 years. This needs to show how you have progressed in roles as well as your achievements. This will need to be supported and signed by all employers over the last 12 years. The attorneys will almost certainly send this to a company to assess and confirm if it is the equivalent of a degree.

The lawyer has asked for detailed experience letter of how I am specialised and have 12 years experience, roles etc. Can this come from me or does it need to come from my boss as if it does it makes it very awkward.

See post number 3 in the thread, where it says:

We had to do this, and my OH had to go back to previous employers and his current and get a detailed letter from each explaining what you've been asked. They submitted that and it got decided by an outside body who went through it all and stated that it did indeed equal a degree. I don't see any way round this I'm afraid, if you really want to make a go of this, you might have to bite the bullet and tell your boss. Looking at it another way, it might give them time to find someone else, should you be successful with your H1-B. I hope it all works out for you, the immigration process is never easy I'm afraid, so good luck

Well the us company has written me experience letter as they know me rather well, unfortunately the us company doesn't own the UK one otherwise it would have been easier. I'll let you know if I get any RFE but lawyer thinks its ok and submitting petition today.

Submitting??? Have they not had your experience assessed to confirm whether it's equivalent to a US bachelor's degree first?

My husband has an H1B (started last Oct) without a degree, he did have 15yrs progressive experience, over 30 related qualifications he had gained in that time too! This was all sent off to be assessed, by Princeton University in his case, they assessed it and decided it was more than equivalent to a degree in Computer Science. This was then submitted with the petition to cover the lack of degree.

I had to get my experience reviewed by an independent body. I thought this was standard.

If you don't have a degree, for an H1-B application, you have to have the equivalent experience, ie 4 years experience for 1 year of degree. This has to be decided by an independent body, who look at the information they get from employers and previous employers, describing how your employment and experience has progressed through the years. Only then do you know if it will be classed as equivalent to a degree.

I hope that it goes well for you, fingers crosses

It's 3 years experience per year of uni study missing, as they're looking for 12 years experience for someone with no university study behind them

yup, no degree here but all my past experience (including employers letters) were sent to a third party who produced an 'equivalency' document that was submitted with the original H1B application many moons ago

Good Luck with it
