Default H1B EXPIRES SOON..GETTING MARRIED.

OK.CURRENTLY I AM ON A H1B VISA WHICH EXPIRES IN 2 MONTHS TIME. MY USC
BOYFRIEND AND I HAVE DECIDED TO MARRY AS HE JUST FOUND OUT HE HAS
LEUKEMIA. WHAT DO I NEED TO DO AND WILL I HAVE TO GO HOME?THANKS.

Please don't SHOUT! Sorry to hear about your boyfriend having leukemia.

Once you are married your boyfriend can sponsor you (I-130) and you can file an adjustment of status (I-485). You should not need to leave the country. Have you been on H-1B for the 6 years?

If you get married and file for adjustment of status before your H-1B expires, you'll be able to stay in legal status the entire time. You will not have to go home.

The main forms are I-130 and I-485. As your H-1B is expiring, you may also want to file I-765 (work permit) and I-131 (permission to travel).

Hi Barry and thanks for posting....sorry for the caps lol..my H1B is
just ending its first 3 years but the job is no longer going to
continue. Tey will be closing and to be honest I wouldnt want to
continue working for them anyway!

Hi and thanks for the reply..........my daughter is also here with
me.so do I file seperate forms for her?

Should I use a lawyer? and if I marry in July will I have time to
file?
