Default H1b Beyond Six Years

Hi,

I would be finishing up my six years in H1B in another four months.
The company who has sponsored me , did start the permanent residency
process two years back but my application is stuck in the DOL. The
company is now out of business and folding up, I was wondering what
are my options. If I find a new employer who is willing to sponsor me,
can they get an H1b approved for me for another three years?

----- If LC was filed more than 365 days try to get the receipt of LC filing, normally SWA or SESA sends the receipt to the lawyer who prepared LC papers, that LC filing receipt has your PD and case # on it If SESA has not sent Lawyer can ask for it. Ask your employer if they have got the LC filing receipt from Lawyer or from SESA, try to get that copy of that letter

---- Once you get the above receipt as evidence that your LC was filed more than 365 days your new employer can get you 7th year H1 extension. You should file for 7th year H1 extension before your current H1b expires. Seek the help of lawyer

You should be able to as long as the new employer will sponsor you
immediately. In that case, the old priority date would still count for the
seventh-year H-1B extension.
