How long did it take your company to get to submitting the petition? My company still hasn't got there and the cap will run out soon!

Hi Richard,

Started in October ended November 18th.

Thats from start to finish, including background checks, premium processing, qualification checks etc. Just need a piece of paper to book my appointment

They started mine on the 26th October. When did they start yours in October?

Good luck with the paperwork then the appointment, you're nearly there.

Are you on premium processing? My actual paper was filled 1st November, but all the background checks etc were done in October

Yes they are going for premium but I don't have a degree and they haven't asked for experience letters yet...getting worried as its only a week or so to go until the cap ends.

Hi All,

I have a question. My petition has been approved but noticed the CAP has been reached and my paperwork still hasn't arrived yet.

How does this impact me, or am I still good to go?

Thanks
Wayne

I think you should be okay, but this is on the USCIS website, don't know if this clarifies it any better:

WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap of 65,000 for fiscal year (FY) 2012. USCIS is notifying the public that yesterday, Nov. 22, 2011, was the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY 2012.

Properly filed cases will be considered received on the date that USCIS physically receives the petition; not the date that the petition was postmarked. USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY 2012 that arrive after Nov. 22, 2011.

Good Luck - I hope it all works out for you
