H1 Transfer Question

Hi All,

I am currently working on a H-1 visa for company X. Suppose Company A were to offer me a
job and apply for my H1. I know that under the new law, I can go and work for A as soon as
I get a WAC #, without actually waiting for the petition to get approved.

Suppose I did join A, and then Co. B offered me a job. Would I be able to join B after I
received the WAC # for B's petition, or till A's petition got approved or till B's
petition got approved ?

Would the answers change if the very first company (X) went out of business after A's
petition had been filed but not yet approved ?

When you receive the receipt notice for B.

Is this true only for transfers or for any H1 applications? For example, in another
thread, someone is asking about changing status from L1 to H1. Does this law apply to that
person too?

Too bad this law wasn't in effect 2.5 years ago when I was changing jobs in H1. The
conditions in my old job were terrible, but I couldn't afford to be without work, so I had
to wait until the new H1 was approved...

The exact conditions are not quite clear yet, but I believe one requirement is that you
must have had H-1B status before. So if you changed from H-1B to L-1, and then back to
H-1B (which is somewhat unusual, but quite possible), you may possibly be able to start
working immediately.
