Hi --

I am on my H1B visa and currently own a home in US. I am planning to move back to
India before end of expiry of my h1 visa. I have my labor and i-140 cleared. I am
trying to sell my home before I move back to India. If in case, I am not able to sell
before my visa expires, what is my status? I am legal to hold a property in US
without living here or have a valid visa? I havent told my employer regarding my
intention because they might lay me off.

Please email me your opinions and any information you have at
[email protected]

Thx Venkat

Apply to change your status to B-2 before you stop working. While it might be denied
because of your I-140, it will at least buy you some time.

My comments are based upon my over 15 years of full time experience as an immigration
attorney. It has not been confirmed by research, and one or more immigration
officials or other attorneys may disagree. This is not legal advice and is provided
on the understanding that no attorney-client relationship is created or intended.
