Default H1-B deportation Issue.. Please I need your advice

Hi,
I am on H1- visa, I am facing removal proceedings (Deportation) .. I met one attorney in NY, he suggested me for voluntary departure, this is the only one solution for me, and also I met on attorney in NY, he his asking $3000 keeping in this country, and the adjustment of status afterwards.


I have some questions..

1) which attorney guide lines I have to follow?.
2) If I get a new job and If the new company will sponsor for my H1-B, then am I eligible for adjustment of status?
3) Can I alone attend the immigration court without an attorney for voluntary departure.. I met some attorney’s but they are asking more money.
4) Is this deportation will effect for Canadian immigration?


Please anyone has any advice, I will thankful to you. If any one facing similar problem please share your experience.

You're no longer on an H1B

If the INS are initiating removal procedings, seems to me that you have
no choice.

If you get a new job and the company sponsors you for an H1B, given that
to be put in removal you've probably overstayed, you're going to have to
leave the US to get a new visa due to zero tolerance policy on
overstays. If your overstay is more than 180 days you face an automatic
3 year bar, if it's over a year you face an automatic 10 year bar.

You can't adjust status just because you have an H1B.

You should be looking at leaving right away, and not wait for any
removal order, or request voluntary departure, and then provide the INS
with proof of your departure.

Yes.

Money will not buy your way into the USA. Save your money for your
airfare home.

Hi,

Just to remind you that you came here on H-1 that means you are qualified
and you survived in this country for quite a long time(I am assuming
overstay to be the reason for deportation).

I would suggest you to immediately start applying for jobs in Canada.

As far as I know, H-1B and Permanent residents of US can go to Canada as a
visitor for less than 30 days.
So should be the same for residents of Canada. I know that Permanent
residents of Canada who are citizens of common wealth country can come to US
and they do not need visitor visa (it is automatically given when they enter
US for less than a specified period)

Once you have a contract job in Canada, many contracting companies would
like to put you on payroll.
And you would be on work visa in Canada. This way if you voluntary go from
US then you save your record "to be deported" in your passport.

Once you are out of US, write to INS with the record that you have already
left the country and they may cancel the deportation proceedings as by that
time you would be outside of US.

Once deported you might end up destroying your chances to enter US in whole
of your life.

That were just my two cents. If you can afford take advise from an
immigrant lawyer who do not ask for that sort of money ($3000) then you
should immediately contact a immigration lawyer. Remember lawyers only
represent their clients. They cannot change rules for you that includes
allowing you to stay even if INS wants to deport you.

Hi,

Thanks for your kind sugessitions..


But if I leave the usa with out voluntary departure I am unable to come this country back..

That's why I am planning to take the voluntary departure and I will move to out of usa..

If you leave WITH voluntary departure you still won't be able to come
back if you've overstayed more than 6 months!
