Green Card Lottery and TN-1

Default Green Card Lottery and TN-1

Hi Everybody

I'm a canadian citizen who was not born in Canada and hence can
participate in the Green Card Lottery.
But I'm planning to move to the US on a TN-1 Nafta visa.
Does enlisiting myself in the Green Card Lottery can reduce my chances
of getting a TN-1 visa?

Yes ... A TN-1 would be unavailable to you as soon as your apply
(beware, from all accouts the lottery is going away).

The reason is because applying for the lottery demonstrates definite
immigrant intent on your part. (Unlike the I-140 application which can
be worked around because it's the employer who has immigrant intent for
someone ... maybe you).

You cannot enter the US as a visitor or as a TN once you've applied to
the lottery because both require that you not have immigrant intent.

I've heard it both ways. Some attorneys say taking part in the lottery is a
clear indication of immigrant intent, others claim that because of the small
chance of winning it cannot be compared to applying for an immigrant visa.
Only a small percentage of lottery participants obtain a Green Card, and
many that do decide not to immigrate after all.

In any case, a GC Lottery participant may still truthfully answer 'no' to
the question 'Have you ever applied for an immigrant visa?' when applying
for a non-immigrant visa.

I don't know about the TN visa, but you definitely can legally enter the
US as a visitor (with visa or with visa waiver) if you participate in
the greencard lottery. I did so five times (before I won the lottery),
and I know of at least 25 people who are every year participating in the
lottery and come each at least once a year here as a visitor - that
makes alltogether way more than 250 visits over the last 8 years without
any problem.

What I would not do is coming here as a visitor after I won the
greencard and after I then have returned the immigrant visa applications
to KCC - but let's worry about that later...

When you enter the US you don't get asked "Would you like to live in the
US?", but "Have you ever applied for an immigrant visa?" - and that is
not the case by participating in the greencard lottery.

Can't win if it is no longer offered
