Green Card and Employment
Good morning, all! As I stated before in a previous post, my husband and I are going for his AOS interview tomorrow in Charlotte. I have one final question.....
David's EAD expires April 20. If and when he receives his green card, are we still required to renew his EAD and pay the $175 fee? And, if not, should we risk it and hope he gets his green card, or should we go ahead and re-file? ($175 doesn't come too easy to us.)
Thanks for any and all advice!
Wish us luck!

Laura,
A Permanent Resident does not need employment authorization, it comes with the status.

If it makes you more comfortable, request that the DAO stamp his passport with an I-551 stamp, which indicates he is being processed for permanent residency, and would serve as tangible proof before the actual "greencard" arrives in the mail.
Good luck!

Rene,
Yes, he will still need an EAD. And he has an EAD, valid for another 3 months.
What are the chances that it will take more than 3 months to approve PR status after the interview, and what is David and Laura's tolerance for uncertainty? I don't know, which is why I didn't attempt to answer Laura's 2nd question. That's something that only David and she can answer.

Re: Green Card and Employment
Here is what happened to me:
When you go for the interview you will be told if you ae being granted AOS, which in turn gives you PR. If you are granted PR then you will surrender your EAD, your passport will be stamped and any visa in your passport will be marked as invalid.
So, if your interview goes well I see no reason why you will need to renew the EAD.
I fail to see why it is so difficult to provide a clear, concise answer to the question.
