This is in response to a private message which I do NOT directly respond to. I find it necessary to have this policy of even appearing to create an attorney-client relationship. I may be a lawyer, but I am not YOUR lawyer.

That said:

I had noted the other day that "212(a)" refusals from a CONSULATE are deadly. However, I received a question about a refusal of ENTRY under 212(a)(7).

212(a)(7) covers the grounds of inadmissiblity becuase you don't have the proper visa when applying for entry. By defintion, it is not a ground for refusal of the visa.

The person who posted the PM was apparently refused entry on a visa waiver -- even if on a visa -- it was before 1996 when a refusal by the POE did NOT result in an order of exclusion.
