Hi,

in July 2012 I filed a divorce waiver I-751. My green card status was extended one year. I did early bio and then I sat waiting patiently.

In April, as I had not heard anything yet, I filed an e-request to inquire about my application; I was told that there had been some "delays" in my background check and that I should have an answer within 6 months (my lawyer called in as well). USCIS was pretty much useless in this.

Now, in 20 days my extension letter expires. I have take an INFOPASS appointment for about 8-9 days before the expiration date. Will they stamp my passport and extend my status or should I worry that won't happen?

Your status continues for as long as it takes for USCIS to make a decision on your petition to remove conditions.

What should happen at the InfoPass appointment is that you'll get a stamp that is evidence of your status.

Thanks folks. I will still be allowed to travel abroad, correct? As my lawyer filed on my behalf and I receive an interview invite while abroad, would he be notified as well?

If you get the stamp in your passport, yes... otherwise, no.

He'd still be allowed to travel abroad without the stamp but he may have problems getting back into the US.

Why wouldn't I get my passport stamped? I have been traveling with my extension letter and expired green card so far with no problems... why would that be any different?

My understanding - as highlighted in the attachment - is that I am entitled to receive a passport stamp upon verification of my pending I-751. Am I incorrect in my assertion?

You should not have a problem getting the I-551 stamp in your passport, since your extension letter is about to expire.

I have nothing to contribute to your situation, but dont understand why Your " Background Checks" should be holding things up as you say they have told you for as long as it has???

I would imagine that all main checks were done prior to issuance of the visa and any additional checks required for the I-751 wouldn't take a great deal of time!

I may be out of the loop a little and know things have changed since we did the process 2 years ago and sure someone will enlighten me!

You raise a good point. I did file for a waiver because of divorce, but even in that instance many people who filed for a waiver got their card already. And no, I haven't been convicted for any crime of any time and I have been regularly employed. So, I don't know. It's just distressful because I happen to travel abroad for work and this uncertainty is a bit unnerving. Just taking it one day at a time.

On the other hand: would requesting an extension to my conditional status speed things up?
