Default F1 Visa rejected.Help needed

Hello.

I've been admitted to a undergraduate engineering in an US
university.I'have received my I-20 forms which states that my
education will be paid by 'Family Funds'.I have a sister who lives in
the USA,she works in a big, well paid IT company and she will pay for
my studies.I have affidavit of support from her, bank statements
etc. Also I have my bank statement with 20000$ as an addition to my
sisters affidavit of support. So I went to the embassy with all these
documents: I-20,affidavit of support,my bank statement,excellent toefl
scores (277)... but I was rejected for F1 visa.I'm 25 years old,i'm
working here for 3 years now,I went to university here but I left it
and went to work.I really don't know what is the reason that I didn't
get the visa.Maybe it is that i'm 25 years old and want to study
undergraduate, maybe because my sister is an immigrant there.I think
that the financial stuff is ok.
Any advice on what can I do.Maybe a statement from my firm here that
they will wait for me to come back?
Thanks very, very much for the help

Dame.

Usually you get an explanation why you did not get the visa. In any case, just the fact that you have financies to study is not enough. F1 is a nonimmigrant visa, you need to prove that you are going back to your home country. So, a statement from your company would have been helpful. Also, if you were close to finishing your undergrad, it usually makes mroe sence to go to the graduate school, not go to start undergrad again.

Hello Dame,

There are mainly 3 supervisions under which most of the applicants get rejected ( http://www.immiseek.com/empty2.php?content=uvdenials )

I think you were rejected under "214(b) Intending Immigrant Provision" following may be the reasons :

before we go into the explanation of refusal you should understand the basis of how interviewing officer thinks when he/she calls you for an interview :

when visa officers are trained they are told to presumes that you are an intending immigrant until you prove that you are truly entitled to a non-immigrant status, lots of people get rejected because their interviewing officer becomes sure of their intended status.

so now lets see how you made that visa officer suspicious about you're not comming back to your home country :

1, You sister lives in the US. #1 factor which becomes the reason of rejection, why? because when you come to US, your sister can help you stay and moreover help you settle here. So making someone your financial sponsor for non-immigrant visa who is specially in the US is not a very good idea.

2, Did you had a chance to explain why you left studies and went to work? this factor creates a sence that you might do the same in US, (study for a while then leave and start doing job)

3, lack of family ties (cuz your sister is in US , so in some way you are proving your ties to US )

4, Dont worry aobut your age it is fine.

so if your I-20 says family funds, you should have provided your dad, uncle or anyone living in your home country as a sponsor.

Check your embassy to see when you can reapply and prepare with strong documents. dont worry about the visa officer ( At the Embassy they have a rule that when you reapply, the officer who turned you down cannot see you again. You MUST be interviewed by another officer )

if you want help advice preparing your F1 documents you can post your f1 question at http://www.immiseek.com/v-web/bullet...wforum.php?f=6

Hope this helps
wish you good luck,
Syed
