F1 Student and own company in US?
 
Hello,

My friend is in IS on F1 student visa (currently doing OPT with a
company). He wants to start a partnership with a US permanent
resident. They will be in some type of software creation business.

His questions are:
1. Is he allowed to be part of a partnership while on F1?

2. Is there any type of visa he can apply which will allow him to stay
in US and do business after he is done with the F1?

1. An excellent question!! It has caused some interesting debates among immigration lawyers! Extremely strong arguments can be made that the answer is "no". Equally strong arguments can be made that the answer is "yes."

In today's political climate, the tendency is for INS to take the position of what I call "FTA" for "screw the alien."

2. Maybe. More likely than not, depending on how you go about it. But not enough facts to answer cogently.
