Hi everybody,
I have 2 questions concerning the transition from F1-OPT to H1B.
I read on this newsgroup about people who needed to go to their home
country in order to obtain the H1b visa and status. Is this true for
all countries or only those who probably help terorists?
In other words, can I adjust status from F1-OPT to H1b without leaving
US?
Am I allowed to work while on F1-OPT with a submitted application to
adjust to H1b status?
Thank you very much,
Jay

Yes to both questions. If you need a visa STAMP in your passport, you will
have to go to your home country and get it though.

Neither. It is necessary for people who overstayed their status in the
past, worked illegally, or something like that. It is also necessary for
people who were on a J-1 visa with the home residency requirement.

The term "adjust" refers to something else, be careful with it. You can
normally change from F1-OPT to H-1B within the US.

You can continue to work for as long as your OPT says. Once it expires,
you are allowed to remain in the US, but cannot work until the H-1B is
approved.
