Education Requirements for H1B??
 
Hi,

I am currently in talks with an Oklahoma Company to get a H1b to work in the US for them.

Now they have found an immigration lawyer who I am also in contact with. I have just received an email that has me quite worried.

Basically he is saying for the Education side of the visa that I need the equivalent to a US Degree. I have a UK 3 year Bachelor of Science Degree plus 4 years work experience. The attorney is saying I need 5 years of work experience after my graduation plus my degree does this sound right?

I thought my Degree plus 4 years of work in the 3D Architectural Modelling world would be enough?

Most Bachelor degrees in the US are 4-year courses... when you add that to 4 years work experience, it adds up to 8 years. You're giving them 7.... but it sounds as though they want that extra year.

I thought my Degree plus 4 years of work in the 3D Architectural Modelling world would be enough?

It's enough to satisfy the requirements for an H1b. Whether it's enough for the company is up to them.

Hi:

I have problems with that. However, I have also had many a consultation where client tells me what another attorney told them. I go that doesn't sound right, do you mind if I call the other lawyer inasmuch as we are good friends. In that situation, I have invariably found that what the client heard is not what the attorney said. I wonder if that is what happened here?

The five years experience after graduation is for a different application than the H-1b. I really don't do this area of practice anymore -- but from my past experience I see a couple other ways to handle this.

The above statements are meant to be general in nature. I may be a lawyer, but I am NOT your lawer.

Thanks for the replys.

I totally understand that your not my Lawyer Folinskyinla but I do appreciate your advice/info.

Well there is a possibility he got confused as we were also talking about Green Card applications in the same email. I sent a quick email quirying the 5 year thing and he said he thought my degree was a 4 year one and that when he recives my degree certificate etc he will send it to a company to assess what it equals in the US.

Just hoping my Degree is up to scratch for the US :unsure:.

When I went for an H-1B, my lawyer put together paperwork to show my 3-year bachelors equaled a 4-year US bachelors. The quite lengthy document talked about how in the UK we specialise in 3-subjects (sometimes 4) for A-levels when we are 16. The document basically said 2-years of A-levels plus 3-years of college = 4-year US bachelors.

I would perhaps blow the cobwebs off any of your old A-level docs and send copies of them also.

Heh that could prove difficult lol. I did not do A Levels but a GNVQ, got a distinction which I am told is equal to 2-3 A levels but not sure if this would be seen the same way in the US.
