Dear Experts,

I have a question about EB2 processing. I am currently evaluating
options of applying for a labor certificate through EB2 program. I have
master's degree but only 4 years of experience. The company I am
joining mentioned that they are unable to include minimum requirement
of Masters Degree in any of their positions descriptions. However, they
can advertise my position which will require minimum of 5 years of
experience. Basically speaking position can state: " Bachelors degree
required, Masters degree preferred" but can not state that "Master's
degree is required." They also can state minimum years of experience
(i.e. Minimum of 5 years required).

My question is whether I can still apply as part of EB2 program? With
above qualifications, what are my chances of successfully landing EB2
labor certification?

P.S. Not sure if they would allow this, but I also want to check if it
would be possible to state 5 years + Bachelor Degree, or 3 years +
Masters?

A few weeks ago I spoke with an immigration lawyer in Florida about this. I have BSc + 5 years, and I thought we could use this as the advert. He said no, the advert MUST state Master, and then I would qualify with the Bsc + 5 years as I do not have a master. He did keep saying though that the advert must say masters..

I think you will need to speak with an immigration lawyer!!!
