EAD no longer required for L2 holders

It's official now.
https://www.uscis.gov/policy-manual/...rt-b-chapter-2 Worth pointing out that the implementation of this isn't immediate as CBP still need to amend the I-94s of L2 spouses before it can be used to prove employment authorization. The auto-extension of expired L2 EADs is immediate however. |

And here is the policy alert.
I think the fact that L2 spouses are considered authorized to work (for the purposes of whether someone worked illegally for deportation and AOS purposes) is immediate. It's the ability to use L2 I-94s for I-9 purposes that will need to wait until new I-94s. |

Yeh that makes sense.
My wife's EAD expired in October and thankfully the 180 day auto-extension will allow her to return to work. Unfortunately this settlement doesn't solve the looming bigger problem which is what to do when her I-94 expires in Feb and her I-539 to extend her L-2 is still pending. As I understand at that point she will once again lose employment authorization on account of being out-of-status. |

Hi- has anybody on L2 had their I94 updated yet? I’m aware USCIS have until March to implement the annotation to I94 but some online blogs state their I94 were updated as of yesterday when they arrived back at a US airport but I can’t find any official confirmation this has now been rolled out.

I read somewhere that someone asked CBP deffered inspection to change their i94 to L2S which is a new one. I heard this third hand YMMV

Reddit users reporting L2S holders can now get updated i94s. Also being assigned L2S on port entry.

I also saw somewhere on Reddit (YMMV) that some employers are starting to accept L2S on their i9 forms. But as of yet there is no official guidence on whether it counts...
