E3 Visa - Another Question....
 
Hi All, just another question on the E3 visa. I have been offered a job in Real Estate in New York. It is in distressed sales and is pretty specialised. However, I will require to complete the real estate licence exam when i arrive after a 2 week course. Also the job is fully commission based and so there is no base salary. Will either of these points effect my application?

Non distressed are however.

According to my prospective employer labor supply in this sector is under supply. This would be Distressed sales in larger property transactions of over $10million therefore requiring more expertise. Is property management seen as specialised. Thanks Kevin

Do they care what the employer says?

I am also wondering how would you prove to the officer that you have a degree – and the exam that you are giving within 2 weeks is no degree (or work experience – I suppose even harder) and your work is related to your degree ?


What is a specialty occupation?
The definition of “specialty occupation” is one that requires:
1. A theoretical and practical application of a body of specialized knowledge; and
2. The attainment of a bachelor’s or higher degree in the specific specialty (or its equivalent) as a minimum for entry into the occupation in the United States.

That's official website right ?

The Onet site is sponsored by the US Dept of Labor, which is nothing directly to do with USCIS.

The Canbera site is an official State Department site.

Yup-as I said shouldnt have said USCIS however my source is still valid/legit

Phew!

Mod to the rescue! I have read so much about E-3 but success has been little :))

Although better to be in AU than US for now. But visiting US next year hopefully some success on the way...LOL

Part of the E3 requirements is an LCA that states that the employer will be paying the prevailing wage. I'm not sure how that works if it's entirely commission-based?

Hmm, I think the OP's case just get's more difficult ?

Just comes back to the point - does not matter if one has the
job - one needs a visa ....

I have a degree in property investment and development which is a credited course by the rics which is a worldwide recognised body. I also have practical experience in asset management and sales of property. The 2 week course and exam is just to get my licence to broker in new York.

Well then Augigi raises a good point. Also - is that a specialised occupation remains unknown.

May be others can shed some light ?
