Default E2 Visa - source of funds??

Hi everyone

if i was to get a bank loan, would this source of money be ok to invest into a business? which would then enable me to qualify along with a business plan to get a E2 visa?

Regards

No. The funds must be unencumbered.

It depends. A loan secured by the assets of the business canNOT be used to count towards the investment.

As long as it's a gift and not a loan that ever needs to be repaid, yes.

Again, depending upon the facts, a loan can be a valid source of funds. However,if the loan is secured by the assets of the business, than the funds will not be counted. This is based upon an "at risk" analysis.

I once saw a situation where Investor owned large business in home country and rather than liquidating that business, he borrowed secured by the overseas operation. The investor therefore had no reduction in the amount "at risk" by the loan. No problem as to source of funds and it actually strengthened the other factors needed to qualify for an E visa.
