E2 Visa Passport Stamp Query: Expiry Date Longer than I thought they could allow

Good Morning All,

I hold an E2 Visa which is valid until Jan 2023.

Upon my last entry to the USA in May this year; the stamp on the passport has the "until" date written as Jan 28 2023. Is this an error on the part of the officer as I was under the impression they could be extended for no more than 2 years at a time on re-entry?

Any thoughts and advice would be appreciated.

On my last visa, CB&P were frequently stamping my passport and entering an expiry date after my status was due to expire.

I just ignored it and always deferred to the expiry date of my status.

Check you I94 online. https://i94.cbp.dhs.gov/I94/#/home as this is the date they go by. It is a good idea to check every time you travel as sometimes you are given less than 2 years online and you may not know until after the expiry date. There is a sticky note above I believe regarding this.

Correct, you should have only been given 24 months.

What airport did you fly into? The bigger ones have an i94 correction via email service.

That's actually wrong. You can exist in the country after the expiry of a non-immigrant visa, as long as your i94 is valid, and i94s can be dated beyond your visa expiry.

You misunderstand. I wasn't talking about the visa expiry date. I was talking about the status expiry date.
