Default E2 and Spouse

Quick one (i'm sure), but can the spouse of an E2 visa holder work for the E2 visa holder's company (subject to obtaining an EAD)?

Once they have their EAD they can work for anyone who'll employ them, which would exclude certain government jobs that require the applicant to be a USC or a Permanent Resident.

Excellent question. I've seen it debated both ways on whether the spouse needs an EAD in the first place to work for the company.

Yes you can as long as your are on your his payroll. He will need to fill the petion to USCIS with your A Number and GC will be approved

Of course he can't -- someone who is on an E-2 can't sponsor anyone for an immigrant visa.

He wouldn't be sponsoring for an immigrant visa. She'd be doing an adjustment of status. The answer is still likely "no", however. If it was allowed, everyone would be doing it.

Absolutely, I should have said basically "can't sponsor anyone for anything "! Apart from hiring for an E2 manager's position.

OK thanks, so if my husband who owns the company fils in the petition for GC while she has EAD I still will not get a GC

Perhaps English isn't your first language, but in the first post - you were the spouse, and now you speak of yourself as though you're someone else. There is no basis for your husband's company to petition you for a GC, so it'd be a waste of money to even try.


From where I sit, you write like londonboy450. It's strange because he has parents who are both on an E2 and his mom also has an EAD... and he desperately wants a GC. That's a staggering coincidence!

He even asked a very similar question: "Both parents on E2 Visa. Mother has EAD, Can my father apply for GC on my mother's belief as she works for his company and on payroll and how long will it take to approve" and, similar to you, he doesn't write English very well either!

I am thank you for all the replie .I read some where one family got GC this way that is the only reason I asked this question

There are numerous ways to get a green card, but none on the basis of an E-1 or E-2 visa.

People on E-1 or E-2 visas can and do get green cards, for example through a family connection, or an EB-5, or the spouse with an EAD gets their own visa under an H-1A/B, and their employer later sponsors them. But there is no basis in an E-1 or E-2 visa to be sponsored for a green card.
