E2 application / I-193 Waiver

Default E2 application / I-193 Waiver

Hi all,

I'm a UK citizen and have been in the US for the past 2 years first in
J1 then H1B and now E2 status.

I am now back in the UK, and have an appointment for a E2 visa next
week, arranged by my new employer.

My concern is that while in H1B status I went on holiday and did not
obtain an H1B visa before returning. I was allowed into the country on
an I-193 Visa/Passport waiver, as I showed the immigration officers that
it was not intentional (it's a long story...).

So, I have been in legal status during my whole time in the US, have
never been refused entry, refused visa etc., but what are the chances
this I-193 waiver will affect my E2 application?

Will I be refused? Subject to extra checks? If anyone has any advice or
experience they could share, I'd be very grateful, as I'm somewhat
concerned.

An I-193 waiver is just as good as an entry with the proper visa in your
passport. No problem there.

The only consequence is that you probably wouldn't be able to get an I-193
waiver again if something like that happened. It's not prohibited by law,
but most people can only get it once in their life. After that, CBP says
that you should know better.
