My guess is that she's from the Philippines as they don't have divorce
over there. I also guess that her Philippine (whatever you want to call
him... hubby, maybe hubby, bio father) did not also apply for a tourist
visa. I'll further guess that her listing a husband staying in the
Philippines helped provide a strong tie to the Philippines and may have
influenced the Consul's decision to issue the tourist visa in the first
place (believing her when she indicated she just wanted to visit the
U.S.).

(Wonder if she was once directed to go read someone's Tourist Visa
Adjustment Of Status page).

Again, all speculation on my part.

OK, so the marriage (or what 'might' have been a marriage) occurred
approximately 12 years ago. You found out something 3 years ago that
leads you to believe you are not actually married.

Curious, when did you fill out the Consular forms for the tourist visa,
where you indicated you had a husband? Was this before or after you
found out something 3 years ago?

yes, a copy of the certificate was required in filing for a tourist
visa and he provided me with that. I was curious because that was the
only time i scrutinized the information and was puzzled as to why the
birthdate was wrong. I was in the US already so i asked a friend to
try to get to the bottom of things and that was how I found out.

So you scrutinized the marriage certificate AFTER you used it to apply for the tourist visa and after you came to the USA? Interesting.

Anyway...the answer to your question is...in my opinion, yes, you need a lawyer.
