Divorce during Condit. Resid (Waive Joint Filing I-751)

What are chances for approval of the waiver of joint filing requirement for the I-751 if
there is a divorce?
Alvena mentions this on her site (scenario 2), but I talked to an immigration
attorney who said that it was really only possible under the circumstances
(battery/death) that are applicable prior to the AOS interview and that chances would
be very very slim for approval.
FYI: he came on a K-1 last November, we got married and filed the AOS in December, and had
AOS interview in Dec 2001. The AOS interview was painless - all they took were letters
from employers, tax return and the work permit card, and of course, didn't want a new
medical, even though our checklist indicated it was necessary. He got the I-551 stamp and
the card should be mailed within a year, I guess.
