Diversity Lottery 2004 question
 

Hello,

I applied and won an entrance into the DV04 lottery, by claiming my
mother's country of birth (Austria) allowed as I am from a non
qualifying country (UK) However the wording on the DV guidelines has
me worried that this does not qualify me as it states :

"You may claim the country of birth of either of your parents, if
neither of your parents lived in, or was born in, the country you were
born."

Both parents were born abroad in qualifying countries but they got
married have lived here in the UK since before my birth. Does this
disqualify me? how would they prove it when it is so long ago? Or will
this be a non-issue with the INS?

Can you offer any advice or direct me to an appropriate person? I
would be most grateful.

Michael,

I do not know the answer to your question, but if I were you I'd
hurry. The BCIS (previously INS) sends more 100,000 letters to green
card lottery winners. Only 55,000 eventually get green cards. Winning
a green card is only 50% of the process. I might be a good idea to get
a lawyer. You can also call the National Visa Center (NVC) to ask
advice. The tel # is 1-603-334-0700 (US tel #).

Folks:

I am generally familiar with both the Visa Lottery concept as well as the DV
application process. What I do not understand is the required TIMING.

Is it possible to apply for DV2004 at this point and time (July) of year
2003?
When is the most appropriate time to apply for DV 2005 ?

The mail in period is usually in October / November. Check here for info: http://travel.state.gov/DV2004.html

They haven't announced the 2005 lottery yet but when they do you should be able to link to it off that site.

I think it is fairly unlikely that you will qualify for the DV program,
because your mother ended up settling in the country in which you were born,
and did not leave. And it is not up to them to prove you are wrong; it is
entirely up to you to prove you are right. Evidence would consist of
documentation of the temporariness of your mother's stay in the U.K.
Typical acceptable reasons: being a student in the country, or a
missionary, or a diplomat, or a refugee. The parent is supposed to have
been in a sort of transitory status when you were born.

You might consider consulting with a good attorney. There are actually
rather few attorneys that specialize in DV program issues, and here's a DV
FAQ of one. It's 5 years old, but refers to several of the tricky issues:
