"Current immigration status" question on forms
 
Various forms ask the question: "What is your current immigration status?".

I entered on a visa waiver which I believe makes me a visitor. I have now been of status for 60 days.

Should I answer the questions as "Visitor (visa waiver)" or must I answer it as "visa waiver - out of status"?

I know that technically the latter is correct. However, I don't want to draw attention to being out of status since I'm guessing it's not looked well upon and if perhaps a reviewing officer might overlook it AND if they won't send the application back for corrections for such (a minor?) point, hence causing a delay.
