Children of an I-129F/Missed Window of Opportunity

Default Children of an I-129F/Missed Window of Opportunity

2 years ago I filed a I-129F and listed my then alien fiancee's
children on all documents submitted to the INS. Her children wished
to remain with their Grandmother and DID NOT apply for the visas they
could have received with I-129F and unfortunately they missed this
window of opportunity. Since this time, we have gone through waiting
period and filed the I-751 {removal of conditions} for my wife. Now
her children find that due to neccessity they may have to come to the
United States. INS told me I would have to file an I-130 [Petition
for Alien Relative]. I was told that the Texas Service Center was
currently working on January 2002 dates. Is there anyway I can speed
up ths process for the children since they are unmarried minors? {13
and 14 years old} Can I file a different way as in "Emergency
Request"? Any help or direction would be appreciated.

Read over the Service Centers expedite criteria and see if any of them apply to your situation. If so, then give it a try. If not, than it is likely a waste of time to try to get the expedite and will only slow down the evaluation of expedite requests by those who truly deserve an expedite based on the expedite criteria and their unique facts/hardship.

Thanks Matthew for the input...I did glance at the Texas Service
Centers Website but I did not find any mention of Expedite Criteria or
Emergency Services. Basically their Grandmother is not in as good of
health as everyone thought. She is looking at having major heart
surgery and she is all the children have in their country...There is
no one else for them. Needless to say we are looking at all options.

Maybe someone can be so kind as to point/link me to the appropriate
website page!

1. Humanitarian Situation where compelling humanitarian needs are present as exists when a U.S. citizen or LPR petitions for a relative (where the visa number is available) who is requiring medical treatment or special care, or in cases where the petition is for a minor child who lacks appropriate supervision or security. Medical documentation may be required.
2. Extreme Emergent or Unforseen Circumstances such as when a petitioner, through no fault of his own, is faced with an emergency as occurs with nonimmigrant petitions for members of the arts such as when a musician, singer or other performer approved for a nonimmigrant classification is suddenly stricken with an illness and must be immediately replaced.
3. Severe Financial Loss To Company or Individual such as when failure to adjudicate a petition within a specific time frame would cause severe financial harm or loss to a U.S. entity and no other remedy exists.
4. Service Error such as when the service has made an error in processing a case and that error has delayed the receipt of a lawful benefit.
5. Dept. of Defense or National Interest Situation: The request must come from an official U.S. Govt. entity and state that the delay will be detrimental to our government.
6. Nonprofit status or requesting organization in furtherance of the cultural and social interests of the U.S.
7. Compelling interests of the service.
