Chances of obtaining O1 visa
I am a J 1 exchange visitor who is in fourth year of internal medicine
residency training. Before swicthing to J1 clinical, I spent 1 year
doing research as Post doctoral research fellow at an IV league
medical school. I also published six publications in peer-reviewed
journals. I am scheduled to start my fellowship training in Cardiology
from July. This training will require atleast three years. Since J-1
is granted for 7 years at the most, I am short of 1 year for my
training. I was just told that I can apply for extension of my J-1
status but it will restrict me from applying for J-1 wavier in future.
The other option is to go for O1 visa. I have a couple of questions
regarding O1
1) How easy would it be for me to get O1 status on the basis of this
qualification.
2) Since my home country Pakistan, would it still be possible for me
to get O1 stamp from Canad or Mexico.
3) I was told that for the change of status to O1, I will require
wavier of 2 years residency restriction for my home country. Is it
true? If so is there any way around it to get O1 status?

This O-1 visa category is reserved for those individuals who have risen to the very top of their fields of endeavor and can provide provide documentary evidence to substantiate this claim. To qualify for O-1 visa status, an individual in the sciences, education, business or athletics must demonstrate national or international acclaim and recognition for achievements in the field of expertise by providing evidence of:
1. the receipt of a major, internationally recognized award, OR
2. at least three of the following:
receipt of nationally or internationally recognized prizes or awards for excellence in the field of endeavor;
membership in an association in the field which requires outstanding achievements of its members;
published material in professional or major trade publications or major media about the individual concerning his/her work in the field. (This documentation must include a copy of the article showing the title, date and author. If the article is not in English, a translation must be provided);
evidence of participation on a panel, or individually, as a judge of the work of others. (This can include participation as a panel of experts for a Ph.D. defense and/or review of articles and books prior to publication.);
scientific, scholarly, or business-related contributions of major significance to the field. (This documentation should take the form of letters from peers who are considered to be experts in the field attesting to the individuals major contributions.);
authorship of scholarly articles in the field in professional journals or other major media;
employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation;
high salary or other remuneration commanded by the individual for services.(This must be accompanied by contracts or other reliable evidence.);
other comparable evidence.
On the basis of what you have written, I would say it is unlikely you would qualify for O-1.

A nobel prize in the medicine would qualify for O1 visa with ease.

I had an O-1 for years and am now an LPR. The one thing I would suggest when considering going down the O-1 road is that you talk with an attorney who has a good track record in securing O-1's, preferably someone who is familiar with your field. S/he will give you the best information possible as to what your chances are, and how an application might be put together so that it has a good chance of being approved.
