Can you submit I-130 for the same person twice by two different person?
Hello
I have submitted for my older brother and his family in 1998 under 4th
preference based on family visa. He was issued a case number and given
a priority date of 1998. Currently the state department is processing
people whose priority date is 1993. My mom just became citizen. Can
she apply for my same brother under 3rd preference? Just in case the
3rd preference moves faster than the 4th preference.
Are there any legal restrictions for submitting I-130 for the same
person twice by two different family members? If my mom applies for my
brother, would that void his pending status with the state department
that he obtained from the earlier application by me?
Any help would be appreciated.

I think that indeed, her filing an I-130 would be a very good idea. There
shouldn't be a problem with it, and my expectation is that the 3rd
preference indeed will move faster than the 4th.
