Can a person on an H1-B who will be laid off maintain official status by becoming
a student?
If so is there any restriction on the institution they attend, or the number of
courses they take?
This person is also married to an H1-B holder from India.

Such a person is eligible to maintain legal nonimmigrant status by becoming a
student; there is no guarantee that he or she will be successful in obtaining
F-1 status.

They must attend an institution which is authorized by INS to issue Form I-20, and
they must take enough courses to be considered full-time students.
