H1B's are being refused if RFE is needed. Too many 3rd party consultancy firms taking the piss and putting in applications not completed.

It’s a subtle difference, but it’s enough to disqualify you from a blanket petition unless you have a degree.
That’s why we had to go through individual petition recently for someone, despite otherwise having blanket authorization.

Sure, but blanket differs from individual petition in that it applies to “professionals” rather than “workers”.
It’s a subtle difference, but it’s enough to disqualify you from a blanket petition unless you have a degree.
That’s why we had to go through individual petition recently for someone, despite otherwise having blanket authorization.

I don't believe our attorneys would have gone to the time and expense of filing an individual petition just for the fun of it, so I can only defer to the advice that we were given on this.

I have seen immigration lawyers left to their own devices do things I don’t understand...
2 of us came on L1a’s back in 2010, I had a GC via an EB1C 15 months later because I drove the process forward. My co-worker did not, and for had a different attorney who then moved him to an H1b, and then went through labor cert and then finally a GC 7 years later...
Now I don’t know why they did what they did... but I do know they earned a lot more fees from my coworkers process than mine...

Also people mentioned needing a degree for an H1b, but I thought that could also be fulfilled with enough work experience instead. I thought it was more nuanced than that, i.e. that the role required a degree, but that the applicant could have experience in lieu of that degree in certain circumstances:
” Have education, training, or progressively responsible experience in the specialty that is equivalent to the completion of such a degree, and have recognition of expertise in the specialty through progressively responsible positions directly related to the specialty.**”

That's because there isn't one, at least not directly.
However the key section states:
"An alien, who for one year in the previous 3 years has been employed by a qualifying organization as a manager, executive, or specialized knowledge professional, is eligible to transfer to the United States to a qualifying organization listed in the blanket petition as a manager, executive, or specialized knowledge professional."
The issue is that the language here specifically uses the word "professional" rather than "worker", and the general hallmark of a professional (but by no means the only one) is the possession of a bachelor's degree.
That's how it was put to us at any rate, although if people are claiming that they have been able to qualify for a blanket L-1B without one then who knows - its a moot point now at any rate!

This thread was really useful for me so thought I'd share my experience of the L1B visa process in Belfast recently:
Like others, I was advised to go to Belfast for the interview rather than London. I took cash and on the day, they were charging £425 for the $500 fee. At least one other in the room had a card that didn't work and had to walk a while to get cash out.
I arrived for my appointment quite early and was in and out within 45 minutes. I read somewhere that if your passport photo was uploaded successfully on the DS160 you don't need to bring a passport picture but I brought one just in case and they did ask for it. Quite a few others were there for L1 visas too.
You are first seen by a woman who checks you in and takes in your documents. Next you are called up to pay the fee. Lastly you're called for the interview in a separate room. Mine lasted a couple of minutes - I was asked how long I'd worked for my company, where I was going, what my specialisation was and what degree I had (mine is completely unrelated but I wasn't asked anything about transferable skills). I had prepared a concise answer for the specialisation question in particular because my firm had advised there's been more scrutiny placed on L1 applications.
It all went well and it was approved! I'd say do have a think about what your answers will be and be confident but overall a much easier experience than I thought it would be. Good luck!

Last year I gave L-1 B interview and I think it is not difficult as people said. We only need to prepare ourselves with the requirement paper. You can easily search basic questions on google for interviews.
