Default B1 in lieu of H

Hi, I have a B1 in lieu of H visa as I’m on a short term contract with a global org with offices in CT.
I’m a self employed contractor, my visa is valid until Feb 2020, I make multiple visits each under 90 days at a time.
I’m considering a permanent move to the US as there’s a real lack of skills in the area I specialise in therefore the amount of work available is higher than the UK.
How easy is it to go from the type of visa I have just now to permanent? Also, how does this work if you’re self employed? (I run my own consultancy, I’m the only employee - I’d be moving this business with me if possible.)

Thanks in advance, Laura

You're not an employee, so that rules out an employer petitioning for a Green Card for you.

You might look at an E2, but that has no direct route to a Green Card.

You might look at self petitioning an EB2 with a National Interest Waiver, but they aren't exactly easy to get.

You could invest $500k and get an EB5

My recommendation is to consult an immigration attorney. No option that you have here is a) cheap or b) easy to petition for and get yourself.

You could also use your UK Ltd company to apply for an E1 visa, which doesn't require investment. You could then continue to work as a consultant for US clients under a corp-to-corp arrangement, only. It's a hassle when it comes to filing taxes though. There is also no route to green card. As mentioned, you could also see if you are eligible for a EB2 NIW if you want a green card and to be able to apply for non corp-to-corp roles.

Very difficult for a self employed person, most either end up as Employees or use the alternative route.
